Malaysian National Fatwa Council and its celebration of religious diversities

Abstract

This research examines the Malaysian National Fatwa Council and its celebration of religious diversities in issuing fatwa, and the discussion is through the use of the descriptive method which means describing the facts of the topic, studying the Muslim scholars’ opinions and finally analyzing them to come up with reasonable and acceptable results. This study has taken into account the reality of fatwa giving process in order to document procedures and challenges of the matter. The researcher considers the references in Islamic jurisprudence and Usul Fiqh in examining judgements offered by Islamic scholars. The researcher critically studies fatwas issued by the National Fatwa Council as well as examines the fatwa process. The researcher concludes that the National Fatwa Council follows the regulation in issuing a fatwa.

يدرس هذا البحث ضابط مراعاة أقدار التدين في النفوس في الفتوى ومدى انضباط مجلس الإفتاء الوطني الماليزي به. وتتم المناقشة من خلال استخدام المنهج الوصفي النقدي لوصف حقيقة الموضوع، وتتبّع أقوال العلماء عنه ودراستها في المراجع المعتبرة في الفقه الإسلامي وأصوله ، ثم الخروج بنتيجة معقولة مناسبة. وقد استخرجت التوجيهات والقيم من الأحكام الإسلامية وربطها بالواقع الحالي للأمة الإسلامية حتى لا تبقى هذه الدراسة مجرد تنظيرات خيالية بعيدة عن واقع الأمة. وقام الباحث بالتأمّلات والنقد حول الفتاوى الصادرة من مجلس الإفتاء الوطني وعملية الإفتاء فيه. وقد استنتج الباحث أنّ مجلس الإفتاء الوطني يتمسك بهذا الضابط في الفتوى.
