Abstract

The purpose of this research is to provide explanations on the concept of matrimonial property and its perceptions based on the Sharia Islamic law from the aspect of conditions and principles, along with the manners to reach an agreement for the matrimonial property during marriage solemnization as well as the ways to divide it during a divorce. The research is vital considering the topic has always been a point of contention among the community, especially the Malaysian community where it always involves disputes of husband and wife regarding the matrimonial property and their rights for their possessions within their married life. This research was conducted using the qualitative method by collecting related information and analyze the data obtained to acquire the most accurate results for this topic.
