Abstract

The idea of ​​this research revolves around the discussion of the evidence of those who say the legitimacy of joint money between spouses in the event of their marriage or separation through divorce or death as inferred to the prevailing custom in Malaysian society. The research concluded with several results, the most important of which are: The norms of custom in its fundamental sense are inconsistent with the custom of the Malay community and considering this as a corrupt custom that is not fit to be a legitimate evidence for the legitimacy of the money shared between the spouses. The researcher recommended that the money shared between the spouses be legitimate with a gift, company, or loan, with the application of the jurisprudential rulings pertaining to each transaction and the presentation of evidence proving the rights of each party in the case of a dispute before the court.
